ESSENTIAL EXTRACTION CORPORATION LIMITED 3 MONTH WARRANTY

Essential Extraction Corporation warrants that the enclosed Ousia Fountain™ product was originally manufactured free of defects in material, workmanship, and mechanical function.  Essential Extraction Corporation will correct any manufacturing defect in the Ousia Fountain™ product for the original purchaser, free of charge, with the same or comparable quality components; provided that, the Ousia Fountain™ product is returned freight prepaid to:

 The Ousia Fountain™ product is sold “as is” with no implied contractual rights or warranties beyond those expressly stated herein.  This limited 3 month warranty is in lieu of all other express or implied warranties, obligations or liabilities.

THERE ARE NO EXPRESS WARRANTIES WHICH EXTEND BEYOND THE FACE HEREOF AND ALL IMPLIED WARRANTIES INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE ARE SPECIFICALLY EXCLUDED.

IN NO EVENT SHALL ESSENTIAL EXTRACTION CORPORATION BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, ECONOMIC, OR CONSEQUENTIAL DAMAGES, WHATSOEVER, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY TO PURCHASER OR ANY OTHER THIRD PARTY, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR ANY OTHER INJURY OR PECUNIARY LOSS, OR DAMAGE ARISING OUT OF THE USE OF OR INABILITY TO USE THE OUSIA FOUNTAIN PRODUCT.

The limited 3 month warranty extends to the original owner and is not transferable to any other person.  The warranty does not apply to any accessory items attached or appurtenant to the Ousia Fountain™ product and excludes Ousia Fountain™ products damaged due to normal wear and tear, unauthorized modifications, embellishments or alterations, improper use, improper maintenance, improper installation, accident, misuse, negligence, damage, or if the product is used for a purpose for which it was not designed or not used in accordance with the Ousia Fountain™ product instruction. Essential Extraction Corporation will use reasonable discretion to determine the validity of warranty claims.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow limitations of implied warranties or on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. No amendment or alteration, written or verbal, to this warranty is authorized.

EXLUSIVE OBLIGATION
Essential Extraction Corps products have been designed for a variety of uses but was neither designed nor manufactured as a product for lethal purposes. This product may not be used for unlawful purposes and that use is expressly prohibited under the terms and conditions of its use.

EFFECT OF THE WARRANTY

1. Within the warranty period, Ousia Labs may, at its sole discretion: (i) repair the product with new or refurbished parts, (ii) replace the product entirely, either with a new or refurbished product at no additional charge to the consumer, or (iii) reimburse the consumer the amount of the original purchase price (a “Reimbursement”); (iv) replace defective parts that meet the performance specifications of new parts for any applicable Product.
2. All exchanged or substituted parts and products replaced under warranty service will become the property of Ousia Labs. Repaired or replaced products or parts thereof will be warranted by Ousia Labs for the balance of the original warranty period or ninety (90) days from the date of warranty service, whichever is longer.
3. In the event replacement parts or a replacement product are not available for any reason at the time of the initiation of a product warranty claim by the consumer, Ousia Labs may, in its sole discretion, either (i) deliver to the consumer an accommodation in the form of a reasonably similar product (an “accommodation”), or (ii) provide reimbursement. Any such accommodation or reimbursement to the consumer shall be in full satisfaction of any applicable product warranty claim and of Ousia Labs’ obligation to the consumer under the warranty for such applicable claim. The provision of an accommodation or a reimbursement terminates any further warranty coverage for such applicable product.

Use limitation
You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell, any information, software, products, or services obtained from Essential Extraction Corp’s website or its products unless a contractual relationship exists.

Assumption of Risk
By buying, using, or allowing the use of Essential Extraction Corp’s products, you understand and agree that solvent extraction processes including CO2 are high risk processes and, to the extent permitted by law, YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED WHILE USING ESSENTIAL EXTRACTION CORP’S EQUIPMENT WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF Essential Extraction Corp including but not limited to equipment malfunction from whatever cause, or any other fault of Essential Extraction Corp Additionally, you agree to indemnify, defend, and hold Essential Extraction Corp harmless from any third party claims arising from such High Risk Processes.

Equipment Modification 
Modification of equipment through the use or misuse of Essential Extraction Corp products can lead to equipment malfunction causing serious risk. Risks include but are not limited to equipment damage, serious physical injury, disability and/or death. You are responsible for any modifications you perform on your or anyone else’s equipment using Essential Extraction Corp products. Essential Extraction Corp is not responsible and will not be held liable for any modifications done to equipment through the use or misuse of its product, even if the modifications include but are not limited to, bypassing or eliminating equipment safety features, installing parts that go against the equipment manufacturer safety regulation and standards, and/or improper installation and adjustment of Essential Extraction Corp products. Limited warranty is void if any parts are replaced with aftermarket parts. 

Limitation Of Liability
As set forth above under the limited warranty provisions, Essential Extraction Corp liability is limited to repair or replacement of its products which are returned to it in the specified period. In no event shall Essential Extraction Corp liability exceed the value of the product(s) sold. In no event shall Essential Extraction Corp be liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever arising out of or connected with the use or misuse of any of its products. Limited warranty is void if any parts are replaced with aftermarket parts. Warranty is also void if any gas or liquid other than CO2 is used, unless recommended by Essential Extraction Corp.

Applicable Law
Your order from Essential Extraction Corp., and this disclaimer statement are governed by the laws of the province of Colorado, USA. You hereby consent to the exclusive jurisdiction and venue within the State of Colorado, in all disputes arising out of or relating to the use of this product. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

Modification of Terms and Conditions
Essential Extraction Corp reserves the right to change the terms, conditions, and notices under which it’s products are offered.

Warning
Misuse of products sold by Essential Extraction Corp involves serious risks including injury, disability and death. Purchasers assume all risks.

Inspect Before Each Use
This product must be inspected for use to ensure it has not been damaged in shipment. If damaged, do not use and immediately return the product to Essential Extraction Corp for a replacement.

Service
If the operator misuses the equipment and it needs repairs, the manufacturer will work directly with the customer to order a replacement part and install for a fee plus material cost. Additional shipping fees will apply to customers located outside of the United States. (Please see maintenance package available for purchase).

Extended Warranty Maintenance Package
Customer has the right to purchase a maintenance package at any time for a price of 10% of the purchase price of the machine plus shipping, allowing the customer to send in their machine for cleaning and repairs up to two times per year. Or the second maintained package option is for 20% of the purchase price which allows for up to four submittals. Additional fees will apply to any components which need to be replaced outside of warranty coverage.

Entire Obligation
The PRODUCT LIABILITY DISCLAIMER document states the entire obligation of Essential Extraction Corp with respect to the products. If any part of this disclaimer is determined to be void, invalid, unenforceable, or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effect.
